    So what is the path to the K Visa?


    1. The U.S. citizen is the K Visa Petitioner. The foreign lady is the K Visa Applicant.

    2. The K Visa Petition is filed with the United States Citizenship and Immigration Service (USCIS), which is a part of the U.S. Dept. of Homeland Security. The USCIS processes the K visa, which will be either a K1 visa or a K3 visa.

    3. After approving the K visa petition, the USCIS sends the petition to The National Visa Center (NVC). At this point, the petition is controlled by U.S. State Department, which will direct the NVC to send the visa petition to the applicable U.S. Embassy or Consulate of the foreign lady's native country.

    4. Before sending the K visa petition on to the U.S. Consulate, the NVC performs a security background check on the foreign lady. Assuming the background report is acceptable, the K visa petition is sent to the appropriate U.S. Consulate of the foreign lady's native country.

    5. The U.S. Embassy in her country sends the foreign lady a letter with detailed instructions about submitting the required Personal Biographical Form (called the G-235A) and Affidavit of Support(simply called the AOS). Additionally, she will receive notification of the USCIS website address where she can download all the necessary forms before going to the medical examination and the US Embassy for the interview. Also sent at this time are the requests for other standard documents, like the police clearance, divorce papers (if applicable), birth certificate, etc. These instructions are straightforward---but they do vary from country to country. The documents have been translated into her native "legal" language---which can be a problem for regions with distinct dialects.

    6. The lady completes the forms, satisfies document requests, pays the fee for the visa, and submits everything to the U.S. Consulate. The U.S. Consulate then sends her a set of final instructions with interview date and the required medical exam. Of course, KVisaAttorney.com sends details of all of this to the U.S. Petitioner along with special forms to include with the final petition. This step is crucial as one mistake can raise serious red flags for the immigration officials---which will result in a much more aggressive interrogation of the unsuspecting foreign lady.

    7. After the lady completes the K visa interview, it's time to come to the United States! From this point, it depends on whether she entered the U.S. with a K1 Fiancee Visa or a K3 Marriage Visa. Either way, however, it will ultimately be necessary to file for the Change of Status to which we've already referred. This form is required, and it's what finally changes her status from a non-immigrant to permanent resident. As stated, unlike many other firms we do NOT charge extra for this required filing.

    8. Along the way, the immigration officials will send you memos called "Notices of Action". These memos will inform you of various receipts, approval notices, and transfer notices that are a part of the overall process.

    The ultimate time to complete this overall process depends on the type of visa you've applied for, as well as the foreign lady's native country. The security issues of that country along with the volume of applications can really make a difference.
