The K1 Visa or the K3 Visa?
The answer depends on your particular situation.
This article will explain the differences between
the two types of visas. Once you understand
the differences, you will be able to more easily
decide which type of visa is the best fit for
your circumstances.
Much of the confusion
around these types of visas is due to the fact
their names are quite vague .. . K1 .. . K3 .. .
these names do not tell us very much about these
particular visas.
Thankfully, however,
it is quite simple to give each of them a more
meaningful name which accurately describes that
particular visa's purpose.
K1 Visa
This is more accurately
described as "The Fiance Visa".
K3 Visa
This is more accurately
described as "The Marriage Visa".
If you plan on getting
married in the States, then you will probably
want to apply for the K1 Fiance Visa.
If you plan on getting
married in her country of origin, then you will
probably want to apply for the K3 Marriage Visa.
Now before thinking that
this matter is settled, please read on because
there are some other issues you should take
into consideration. There are some real advantages
and disadvantages to each visa, so please be
aware of them so that you truly do make the
best decision.
The K1 Fiance
Visa: Advantages
1. Even though the two of you are engaged, you may not have spent much uninterrupted
time in each others presence. If this is true,
and you do not know each other very well, the
K1 Fiancee visa makes a lot of sense. With the
K1 Fiancee Visa, you do not have to get married
prior to actually living together. With the
K1 Fiancee Visa, The Lady moves to the US as a
fiance, and the two of you are allowed a 90
day courtship window prior to the wedding. This
provides a realistic opportunity for the two
of you to get to know each other and make a
better decision about the marriage---which can
make all the difference in establishing a more
stable foundation.
2. You send your application
through the U.S. immigration system. At first
glance, dealing with the bureaucracy of the
U.S. Government may not be so appealing. But,
as cumbersome as the U.S. immigration system
may be, there is often far less red tape than
you will find in other countries. Additionally,
you will not have deal with unfamiliar laws
and customs of a foreign country .. . not to
mention the fact that you may not be fluent
in her native language.
3. As for the marriage,
this legal process will also be accomplished
on the basis of U.S. law and custom. This may
result in a cleaner process, as there will not
be the need to comply with unfamiliar rules
and regulations that may not even be recognized
in the States. Additionally, there may not be
nearly as much documentation required at the
time of her move authenticating not only her
immigration status, but the legality of the
wedding as well. With the K1 Fiance Visa, she
gets accepted into the U.S. Immigration system,
she moves to the U.S. for 90 days and you get
married. It's a simpler process.
4. The K1 Fiance Visa
approval is typically quicker than the K3 Marriage
Visa approval because the K1 Fiance Visa requires
only one petition while the K3 Marriage Visa
requires two petitions.
5. She gets to spend
some time in the U.S. prior to committing. This
will alleviate the concerns of "Bride's
Remorse", as she will not feel as though
she made a premature decision. This is a very
important consideration, as she is not only
marrying the man, but a new country as well.
If the U.S. is not a good fit and she becomes
acutely homesick, the opportunity for a happy,
healthy marriage will be dramatically reduced.
6. If you so choose,
you can set up the process so that if there
is a problem with her immigration, you'll have
one principal point of contact--- your English speaking
attorney. You will not get shuffled between
immigration officials who speak a different
language and who will be unfamiliar with your
file.
K1 Fiancee Visa---
Disadvantages
1. The 90 window period from the time she enters
the U.S. is very strict. There's not much flexibility
with the K1 Fiancee Visa. With the K3 Marriage
Visa, however, the wedding planning is much
more flexible---because the K3 Marriage Visa
is applied for after the wedding.
2. The K1 Fiance Visa
may require more persuasion and evidence gathering
in order to demonstrate to the Immigration Officer
that you are both really in love and are planning
to get married upon her arrival in the U.S.
3. Additionally, there
may be a need to make a strong effort to convince
The Lady and her family that your intentions
regarding the fiance visa are sincere and honorable.
The Lady is being asked to take a HUGE leap
in leaving her family to travel to a foreign
land on the promise of a marriage. It's crucial
to always remember this and to be very sensitive
about this issue.
4. The Lady's family
and friends will NOT get to attend the wedding
ceremony in the U.S. unless they could manage
to secure another type of visa such as a tourist
visa, which is difficult to obtain.
5. This visa takes a
minimum of four to six months processing time,
and quite often it's longer. And there's little
if anything you can do about it except to submit
a perfect application.
6. The K1 Fiancee Visa
is valid only for ONE entry by The Lady into
the U.S. Again, with the K1 Fiance Visa, there
is no flexibility: She cannot travel freely
back and forth out of the country. There will
be no exotic, foreign honeymoon. If she is homesick
and wants to check in with family, or if there's
an emergency, she still cannot travel back to
her country of origin. A travel petition or
Petition for Advance Parole can be filed for
her but will usually take 3-5 months for approval
processing.
7. While there is only
one step required to get The Lady to the U.S.,
there will still be the need for additional
post-marriage immigration work once she is in
the States. In addition to the hassle, there
is also the expense of the filing fees for these
administrative requirements.
K3 Marriage Visa---Advantages
1. If the two of you have spend a lot of time
together, and know each other well, the K3 Marriage
Visa may make a lot of sense. Since this visa
first requires that you marry your lady in her
home country, you stay together continuously.
This is no small consideration when you take
the 6 month time-frame for the K1 Fiance Visa.
2. Her family and friends
get to see and experience the wedding ceremony.
Obviously, for many ladies and families, the
wedding day is a once-in-a-lifetime opportunity
which they will want to share together.
3. The K3 Marriage Visa
does not require as much persuasion of both
The Lady's family and the local Immigration
consulate that this is a bona fide sincere relationship.
4. Since the K3 Marriage
Visa grants her immediate U.S. legal residency,
there is a dramatic reduction in future immigration
work
5. A K3 Marriage Visa
allows The Lady to travel back and forth into
and out of the U.S. immediately. As a result,
The Lady may find a much smoother and less restrictive
adjustment to the U.S. as she can freely travel
back to see her family and friends.
K3 Marriage Visa---Disadvantages
1. Foreign countries often require extensive
supporting documentation from a U.S. Citizen
to get married. You may need to file an Affidavit
of Support in that country. Additionally, many
require that you obtain a "Pre-marriage
Visa", which can take some extra time.
2. The laws and customs
of marriage in the foreign country may completely
unfamiliar to any U.S. rule of law. The foreign
rules may not allow for a church ceremony .. .
or, they might demand a church ceremony even
if you are not a member of that particular religion.
3. The process for the
K3 Marriage Visa is two steps, instead of one.
It's a VERY document sensitive process. If you
are missing one single document, or if there
is a single mistake in any document the entire
process comes to a grinding halt. The K3 Marriage
Visa takes a lot of time and patience.
4. All your documents
must be translated into the native language
of that country where you are planning to get
married.
5. Unlike dealing with
a U.S. Immigration Official at a U.S. Embassy,
you will likely deal with many foreign-speaking
officials who either do not speak English, or
speak it only as a second language. Many foreign
bureaucracies require layer upon layer of documents
and fees and will be quite difficult to communicate
with on these crucial technical matters such
as clarifying the proper form and instructions.
6. The K3 Marriage Visa
process may even require that the U.S. gentleman
stay in her home country for a minimum time.
This, obviously, could be quite impractical
because of work and other family obligations.
As you can see, there
are many factors which go into establishing
which is the right visa choice for you. A careful
consideration along with a possible consultation
with a U.S. immigration attorney can go along
way way towards making the right decision on
whether to file for a K1 Fiancee Visa or a K3
Marriage Visa.
