A. Prove Your Relationship.
Regardless of which type of visa you choose

have to "prove your relationship".
By this phrase, we mean that the burden of proof
is on you to show that the two of you do NOT
have a "relationship" that exists
for the purpose of simply getting around immigration
laws so that a foreign national can move to the
United States. This proof includes photos taken
of the two of you together in the past two years. Also,

that show an evolving and growing relationship

a persuasive case on this matter so you'll need to gather

B. Decide on the K1 or K3 Visa.
There are many issues to consider in deciding
whether to apply for a K1 visa or a K3 visa.

to either type of visa. If you want to marry
in the United States, then you'll want to
consider the K1 fiancee visa. If you want
to marry in the fiancee's country, then you'll

C. An Overview of The K1 visa:
1. It's one way visa. The foreign fiance
does not get to travel back and forth, between
countries, with this visa. This visa is ONLY
for an entrance into the United States.
2. It's a one time visa. Once this visa expires,
the immigration officials are not going to
simply extend another one. It's "one
and done" for the K1 visa.
3. It's a 90 day visa. And that's a STRICT
90 days.
4. It's a non-extendable visa. A strict 90
days without extensions. You better have an
organized plan and know what you're doing
with this visa. You snooze; you lose.
5. It's a non-immigrant visa. Whereas some
visas are issued for the more permanent purpose
of obtaining permanent immigrant green-card
status, the K1 visa is strictly understood
to be temporary and brief.
6. It's issued for one purpose---to allow
the foreign fiancee to marry a U.S. citizen
in the U.S.
To sum it up: The K1 visa allows the
foreign fiance a one way, one time entrance
into the U.S. for a firm 90 day period in
order to allow the foreign fiance to marry
the U.S. citizen. If the marriage does not
occur within 90 days, the foreign fiance
must return to her native country.
And the USCIS makes it clear: No exceptions for
this requirement.
After the wedding ceremony, she'll need to
apply for the Adjustment of Status (aka Change
of Status). The Adjustment of Status (AOS)
does just what is says: It changes her status from
as a non-immigrant visa holder to an immigrant
visa holder. It is this immigrant visa which grants
her the right to have permanent residence

D. An Overview of the K3 Marriage Visa:
1. It's NOT a one way visa. The foreign spouse
may travel back and forth, between countries,
with this visa (subject to certain limitations).
2. It lasts for two years.
3. It is extendable in two year increments.
4. It's a non-immigrant visa. Whereas some
visas are issued for the more permanent purpose
of obtaining permanent immigrant green-card
status, the K3 visa is strictly understood
to be temporary, but it's just "less"
temporary than the 90 day K3 visa.
5. It's issued for one purpose---to allow
the foreign spouse to move to the U.S. after
marrying a U.S. citizen.
The K3 visa can provide some real benefits
with regards to the foreign spouse's desire
to travel and work. There are fewer restrictions
with this visa than with the K1 visa.
E. A Few K1 and K3 differences:
1) Generally, it's easier to obtain the K1
visa than the K3 visa. The reason is that
the K1 visa requires less documentation. For
this reason, it's also faster to get than
the K3 visa.
2) The process in bringing children to the
U.S. on a K visa with their mother is simpler
with the K1 visa than it is with the K3 visa.
This can be a major advantage in cases.
3) As stated earlier, a K1 visa requires
that you MUST marry within 90 days of the
foreign fiancee's entrance into the U.S. No
exceptions. If you don't marry in this time-frame,
then the foreign fiance becomes an illegal
alien. Additionally, if the 90 day period
expires, no extension is granted, nor will
an additional visa be granted. Make a mistake
here and the foreign fiance is sent back
to her native country and has to wait a MINIMUM
period of 24 months before reapplying. The
K3 visa, on the other hand, is good for two
years and it's much easier to gain an extension
after the two years expires.
4) A K1 visa requires that another immigration
related application be made---promptly after
the marriage. We referred to this earlier---this
additional application is called the Adjustment
of Status (or Change of Status). The purpose
of this application is to allow the visa holder
to obtain permanent resident status. The K3
visa also calls for an Adjustment of Status,
but without nearly any of the time pressures
that always seem to be bearing down upon K1
visa holders. Considering that this Adjustment
of Status process can take up to 8 months
and that the K1 visa holder (but NOT the K3
visa holder) faces severe travel and work
restrictions during this time, this issue
can present the K1 visa holder with some real
hardships if the couple is not prepared.
Each of these visas has distinct advantages
and disadvantages. It is very important to
understand these distinctions when making

F. Can my Fiancee just get a Tourist
Visa (aka Visitor Visa)
At this point, you may be tempted to opt of
either visa process. You may want to see
if you cannot just get a simple Tourist or Visitor Visa.
No such luck. It's highly unlikely that the
immigration official will grant her this kind
of visa. The USCIS suspects that a single
foreign woman making such an application is
simply coming to the U.S. to nab a husband
and to get a higher paying job at the expense
of current citizens.
G. Children and the K Visa
With respect to her children, the requirements,
again, are different between K1 visas and
K3 visas.
With a K1 visa, her child goes for a K2 visa.
In this situation, the child is simply merely
noted on the visa petition. The child must
be under the age of 21, though. Also the child
must not be married, either. Like the parent,
the child must also apply for an Adjustment
of Status.
With a K3 visa, her child goes for a K4 visa.
Just like with the K3 visa, the child is simply
merely noted on the visa petition. The child
must be under the age of 21, though. Also
the child must not be married, either. Like
the parent, the child must also apply for
an Adjustment of Status.
There are some important considerations in
connection with the K4 visa. Yes, the child
can move to the U.S., BUT, in order for the
child to eventually become a permanent legal
resident of the U.S., a separate petition
(I-130) should be filed. Additionally, the
child must have been under 18 at the time
of your marriage---otherwise, the child must
return to the foreign spouse's native country
upon turning 21. [How would you like to have
missed that little detail! Imagine finding
this out after the fact and breaking that
news to your spouse or child! The K visa process
is filled with these kinds of life altering
details. This is not a process to be taken
